By downloading, installing, or using TrackShot ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. App Description

TrackShot is a health and wellness application designed to help users track GLP-1 and related medications. The App allows you to:

• Log medication injections (dose, site, timing)
• View estimated medication effect cycles and blood level visualizations
• Track weight, progress photos, and wellbeing indicators
• Record side effects, mood, appetite, and other daily metrics
• Sync data across devices via iCloud

3. Medical Disclaimer

TrackShot is not a medical device and does not provide medical advice.

The information provided by TrackShot — including medication effect cycles, blood level graphs, and any other visualizations or data — is for informational and educational purposes only. It should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult with your healthcare provider before making any changes to your medication regimen. If you experience any adverse effects, contact your doctor immediately.

The blood level graphs and effect cycle estimates are approximations based on general pharmacokinetic data and may not accurately reflect your individual response to medication.

4. Eligibility

You must be at least 13 years of age to use TrackShot. By using the App, you represent and warrant that you meet this age requirement.

5. Subscriptions

TrackShot offers both free and premium ("TrackShot+") tiers.

Free Tier

The free tier provides core medication tracking features at no cost.

TrackShot+ Subscription

• TrackShot+ is available as a weekly, monthly, or annual subscription
• All subscriptions include a 7-day free trial
• Subscriptions are managed and billed through Apple's App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your Apple ID account settings

Pricing

• Weekly: $2.99/week
• Monthly: $4.99/month
• Annual: $29.99/year ($2.50/month)

6. Intellectual Property

All content, design, graphics, code, and other materials in TrackShot are the intellectual property of DAXT B.V. and are protected by applicable copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without prior written consent
• Remove or alter any proprietary notices in the App

7. User Data and Privacy

Your use of TrackShot is also governed by our Privacy Policy. By using the App, you acknowledge that you have read and understood our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• TrackShot and DAXT B.V. are provided "as is" without warranties of any kind, whether express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability shall not exceed the amount you have paid for TrackShot+ in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless DAXT B.V., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
